Wife suspended over comments on facebook, advice!

Just after a little advice.

Wife was paid late again, bank charges etc etc. so she had a rant over it on Facebook but did not name the company.

But some one reported her to her management and they have suspended Her on full pay, can she be sacked even though she didn't name company, person etc etc.

No idea but a good reason for belonging to a union and also a good reason to avoid Facebook.

The company can do anything they like. What matters is the comeback to that.

I don't believe that an employment tribunal would rule against her, as the company hadn't fulfilled its contractual obligations to her - tho it would depend on how reasonable her words were against the facts.

I don't think her not naming the company would matter much, cos it can be assumed that her friends know who she works for.

Another warning about unguarded Facebook comments. I know of one local authority that regularly trawls facebook comments of people off sick. Things like "Had a great night out last night, partying till 2." can drop people right in it.

locally there were a number of teachers who got suspended over comments they made on facebook about some of their pupils being scumbags. i am less and less amazed at how stupid some people are on FB.

OP's missus excepted obviously, that sounds like a geniune reason to be miffed, and something most people would reasonably expect to read about (or hear in the pub)

It may also depend on how they are worded the disciplinary lettter and whether that in the companies handbook / policies is classed as misconduct or gross misconduct. Say the alleged offence is 'conduct which is damaging to our reputation' and that is classed as gross misconduct there is the potential for dismissal. However if the alleged offence is only classed as misconduct in their policy it would be very hard to dismiss her.

Did she make the comments on facebook from her work computer? or in work time? or both?

Sorry to have to say this, but I hope you have called her an utter cretin for putting herself in this position (perhaps wait a few weeks for the dust to settle before you do this actually).

How people think they can get away with saying whatever they please under their own name on such a well known website is beyond me.

I find it far more effective to get my rants out the way/hurl abuse at people on anonymous messageboards under usernames which bear no relation to my real name.

I thought it was on her Facebook page so no one would see. Turns out it was on mine and a few of them read it. It was a tad awkward at work on the Monday morning.

The company I work for got rid of a load of people because of racist and sexist jokes / comments they had made to each other via email. Got to be very careful with spyware which looks for trigger words etc. Apparently writing down the city Sc**thorpe triggers off the system as it has the word c*nt in it. Fortunately I have access to a stand alone system so can say things like Fuck off, without fear of reprisal.
