Shit ? Really ? Thanks for pointing that out... You don't think it would come up during questioning of a suspect ? Seems pretty obvious to me... and most the court room given the reaction from the public gallery during most of the questioning by the defence. Anyway, haven't got time to play "state the fucking obvious" with you :P

this is my thinking on the way its progressed: the police assumed they had caught him red handed, thought the trial would be a piece of cake so didn't bother doing any solid work to back up their claims as they thought the defence would have nothing.

am probably wrong in that thinking but it could be possible.

will be resolved either way though i'm sure

Never the less...

I think it safe to say there are currently some concerning gaps coming to light in their prosecutions theory of premeditated murder. Specially considering, at this stage, all the forensic evidence backs up OP version of events and not the one originally suggested by the prosecution.

Obviously there maybe more to come...

Another game of state the fucking obvious being played out here :P

What we do know is the lead detective has fallen apart on the stand this early and it looks he is about to be taken off the case.

Its clear the summary "evidence" or theories depending how harsh you want to be, that lead to the prosecution believing this was premeditated murder has been blown apart. Everything they currently know seems to have been laid out to the court and withstanding something popping up going forward, something new, it seems the presumption this premeditated murder is somewhat on dodgy ground.

No one said it wasn't a case of murder. Just that premeditated murder seems weak as hell. Anyway ignoring the child shouting in the corner for attention....

Listening to the prosecution now...

Prosecution making the case that its at least murder with direct intent.

On the issue or murder or not. No idea how it works if what OP is saying is truthful. Would it class as murder ? or is there a route out for him at some point ? Manslaughter for example ?

I don't disagree with that... I find it bizarre as well... Although I wouldn't as dismissive of the defense position as much as you.

Bizarre isn't enough surely for a murder charge of any salt to stick.

All we have at the moment is OP saying he shot is girlfriend thinking it was a burglar. As a starting point I don't know what that is classified as. Murder ? Manslaughter ? Unintentional homicide ?

it's possible to think of several plausible scenarios, such as - OP and his girlfriend have an argument. She storms off to the toilet and locks herself inside. He completely loses control when she refuses to come out and, in a fit of extreme temper, unloads his gun through the door...

I'd say that her empty bladder blows that theory out of the water.

When a person has just locked herself in the bathroom to avoid an argument they're not immediately thinking "oh, while i'm here I'll have a piss", are they? :)

No, but she might have had a piss and then they had the argument...who knows, we weren't there...

whatever scenario you choose, it's no less plausible than "I thought I heard a burglar, the toilet door was locked so I shot several times through it without checking who was there...."

I believe it's a shoot-first and ask-questions-later society, so I don't think that part of it is anywhere near as weird within South Africa as it appears to us here.

How's about: she gets up and goes to the bathroom. Her doing that wakes him up (without him knowing that's what's woken him up), and he sees the balcony door is open which concerns him because of the high crime. As he shuts it while worrying about the high crime he hears a noise in the bathroom, thinks it's an intruder so grabs his gun and goes and shoots .... and all the while he hadn't thought about whether his girlfriend was there because sometimes she's there and sometimes she's not.

It's plausible, and while it takes a freak set of circumstances and state of mind, coincidences do happen.

At the end of the day, it sounds like the only evidence for murder is that's she's dead - but that's no less evidence for a defence such as the one I've given.
