If he could prove you'd done it he could call discrimination though. It's the reason asking apps to sign into Facebook at an interview is the worst thing to do. Sexual preference, religion... all there.

you don't have to give a reason for rejecting someone though and if they ask just say the other person was better, so it's hardly ever gonna be stopped from being used

I know, just saying that all employers do it and it's extremely hard to prove they have, so people need to be careful. Also we could have taken him on and then terminated him immediately for gross misconduct for breaching the company's social media policy. But that would've been far messier for him.
